Shri Prabhakar Nath Mishra, Advocate has put in appearance on behalf of opposite party No.4 by filing Vakalatnama, which is taken on record.

Heard learned counsel for the petitioner, learned A.G.A. for the State and Shri Prabhakar Nath Mishra, learned counsel for the opposite party No.4 and perused the record.

This writ petition has been filed with a prayer to issue a writ, order or direction in the nature of certiorari for quashing the First Information Report dated 02.02.2024, bearing Case Crime No.0040 of 2024, under Sections 498-A, 315, 354, 354-B, 323 IPC and Section 3 & 4 D.P. Act, 1961, Police Station - Gudamba, District - Lucknow.

In compliance of this Court's order dated 03.04.2024, opposite party No.4- Smt. Supriya Gupta is present in court in person, who has been brought by Sub Inspector Sanjay Kumar and Lady Constable Annpurna Tiwari. She has been identified by her counsel Shri Prabhakar Nath Mishra. Petitioner is also present before this court in person, duly identified by his counsel.

In compliance of this Court's order, petitioner has produced a demand draft of Rs.50,000/-. Learned counsel for the petitioner is directed to deposit the same before the Senior Registrar of this court within 12.04.2024.

Subject to deposit of the aforesaid amount, petitioner and opposite party No.4 shall appear before the Mediation and Conciliation Center of this Court at Lucknow on 22nd April, 2024. On appearance of opposite party No.4 before the Mediation and Conciliation Center of this Court, the amount so deposited by the petitioner shall be released in favour of opposite party No.4.

Let sincere efforts be made by the mediators and submit the report accordingly.

List this case on 27th May, 2024, showing name of Shri Prabhakar Nath Mishra in the cause list as counsel for the opposite parties.

Interim order granted earlier shall continue till the next date of listing.
