(1) We have heard Shri Arunendra Mohan Shukla, appearing for the petitioners and Shri Ashok Kumar Singh, for the private respondents at length.

(2) This writ petition has been filed with the following main prayer:

"i) issue a writ, order order or direction in the nature of Certiorari thereby quashing of the impugned F.I.R. lodged by the Opposite party no.3 which is registered as Case Crime No.0042 of 2024, U/s 406, 420, 467, 468, 471 I.P.C., P.S.- Gudamba, District Lucknow (North) [contained as Annexure no.1]."

(3) After having heard the learned counsel for the parties, this Court is of the considered opinion that the matter can be settled by way of Mediation as the dispute is of monetary in nature regarding forging of signatures and taking out money from the Bank account that was to be jointly operated by the petitioners and the Opposite party no.3, therefore, the matter may be referred to the Mediation and Conciliation Centre of this Court.

(4) Shri Ashok Kumar Singh, who appears for the Opposite party no.3, has instructions to say that the Opposite party no.3 is willing to get the dispute settled outside the Court through Mediation.

(5) Taking into account the statement of learned counsel for the petitioners, the petitioners shall deposit a sum of Rs.15,00,000/- (Rupees Fifteen Lacs only) within a period of one week with the Mediation & Conciliation Centre, High Court, Lucknow, by way of Bank Draft drawn

in favour of Senior Registrar, Mediation & Conciliation Centre, High Court, Lucknow, which shall be kept in an interest bearing account by the next date of listing.

(6) It is made clear that the said Bank Draft of Rs.15,00,000/- shall not be released to any of the parties during the pendency of this petition.

(7) List this case on 20.03.2024.

(8) We will pass further orders only after satisfying itself about the bonafide intention of the petitioners to genuinely participate in the mediation proceedings to try and resolve the dispute.
