During the course of hearing, it is not disputed by learned counsel for the appellant that the subject FIR has been registered against Vijendra and others for alleged commission of offence against daughter of opposite party no.4, who has been sent to Nari Niketan, Lucknow, vide impugned order dated 02.08.2024. Learned counsel contends that the order impugned is unsustainable as the victim is major who willingly resided with the accusedVijendra.
When confronted with the locus of the accused- Vijendra to maintain the appeal as no such grievance has been raised by the complainant's daughter regarding sending her to Nari Niketan, Lucknow, learned counsel prays for time to address the issue of maintainability of the appeal.
Adjourned to 16.12.2024, as fresh.
Meanwhile, learned State Counsel shall seek instructions in the matter.
