Iqrar Ahmad-Appellant has filed this appeal under Section 14-A(2) Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 to challenge the order dated 28.5.2024 passed by Special Judge, SC/ST Act, Gautam Buddh Nagar, whereby his application under Section 439 Cr.P.C. for grant of regular bail, during the pendency of trial in Case Crime No. 223 of 2024, under Sections 147, 149, 452, 307, 394, 427, 323, 504, 506, 34 I.P.C. and 3(2)5 Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station Phase-I, District Gautam Buddh Nagar has been rejected.
Learned Senior Counsel states that after completion of investigation, the charge sheet against the appellant has been filed for the offences, which are bailable in nature. According to learned Senior Counsel, with this development, the apprehension of arrest by appellant arising at the stage of registration of the F.I.R. has ceased to exist, therefore, he prays for withdrawal of this appeal.
