Heard learned counsel for the applicant, learned AGA for the State and Sri Mohammad Nauman, Advocate alongwith Sri Shivjeet Kidwai, Advocate, who have filed the Vakalatnama on behalf of opposite party No.2 which is taken on record, as well as perused the record.

Present appeal has been filed under Section 14-A (2) of Scheduled Castes and Scheduled Tribes Act, 1989 against the impugned order dated 15.10.2024 passed by Special Judge, SC/ST Act, Barabanki in Bail Application No.3005 of 2024, arising out of Case Crime No.424 of 2021, under Section 419, 420, 467, 468, 471, 120B IPC & Section 3(2)(v) of S.C./S.T. Act, P.S.-Kotwali Nagar, District-Barabanki.

After arguing, at some length, learned counsel for the appellant has submitted that liberty may be given to the appellant to file bail application before the trial court which may be decided in view of law laid down by Hon'ble Supreme Court in the case of Satender Kumar Antil versus Central Bureau of Investigation and another, (2022) 10 S.C.R. 351 : (2022) 10 SCC 51 as also to prefer a discharge application before the court below and the same may be decided expeditiously.

Learned AGA has no objection to the prayer made by learned counsel for the appellant.

Keeping in view the aforesaid, the present application is disposed of with liberty, as prayed for, and with a direction to the court below that if the appellant apply for bail before the Court concerned, his prayer for bail shall be considered and decided expeditiously in accordance with law.

With the aforesaid observations, the appeal is disposed of.
