Heard Sri Manish Mani Sharma, learned counsel for the appellants, Sri Nikhil Singh, learned AGA-I for the State and Ms. Roni Yadav, Advocate holding brief of Sri Sanjai Kumar Singh, learned counsel for the respondent No. 2/complainant.

By means of present appeal, the appellants have assailed the order dated 12.01.2024, whereby, the trial court rejected two application(s) preferred under Section 227 Cr.P.C, one by appellant No. 1/Haneef and another by appellant No. 2/Mohd. Safi s/o Haneef alongwith Haseeb @ Zulla s/o Haneef and Sadru s/o Faiyyaz Khan.

Brief facts of the case are to the effect that an FIR was lodged by one Mukesh/respondent on 27.10.2021 at about 11.00 AM at P.S. Nighasan, District Kheri against five named persons namely Mohd. Haneef, Zulla, Mohd. Safi, Attaulla Khan & Sadru and four-five unknown persons and taking note of the allegations made in the FIR, the same was lodged under Sections 147, 148, 149, 307, 504, 506 IPC and Section 3(2)(v) of SC/ST Act.

The prosecution case, as appears, is to the effect that in the FIR, general allegations were levelled against all accused regarding causing injury to one Rejendra Pasi by sharp edged weapon and by hard and blunt object (steel rod). In the FIR, it has also been alleged that the accused burst fire.

After due investigation as also taking note of the statements of the witnesses and the medical opinion, the charge sheet was filed in above indicated sections.

Thereafter, the trial court took cognizance and on appearance during trial, the appellant No. 1/Haneef and appellant No. 2/Mohd. Safi s/o Haneef alongwith Haseeb @ Zulla s/o Haneef and Sadru s/o Faiyyaz Khan preferred the application(s), indicated above, under Section 227 Cr.P.C.

A perusal of the application(s), which are on record, it is apparent that the applicants including the appellants in the applications basically stated that there is no injury of firearm and accordingly, Section 307 IPC would not be attracted at all and based upon the story of prosecution, the utmost offence would be under Section 325 IPC.

The trial court after considering the evidence on record rejected the

application(s) by means of the order impugned dated 12.01.2024. Relevant portion of the order dated 12.01.2024 on reproduction reads as under:-

From the application(s) itself, it is apparent that the appellants have not stated about other sections indicated in the charge sheet. The appellants have only stated that in the facts and circumstances of the case and evidence collected during investigation by the Investigating Officer, only Section 325 IPC would be attracted.

The trial court after considering the averments made in the application(s) under Section 227 Cr.P.C. as also the material available on record as also the judgments on the issue observed that at this stage mini trial cannot be carried out and as to whether, the offence is made out under Section 307 IPC or under Section 325 IPC would be considered at the time of final disposal of the case.

The offence aforesaid, to the view of this Court, are justified and accordingly this Court finds that no interference is required in the order impugned dated 12.01.2024. The instant appeal is accordingly dismissed .
