Appellant/Applicant has been convicted and sentenced under Section 307/34 IPC for seven year rigorous imprisonment with a fine of Rs.5,000/- in default of which three months additional simple imprisonment; under Section 504 for one year rigorous imprisonment with a fine of Rs.1,000/- in default of which one month additional simple imprisonment; and under Section 506 IPC for one year rigorous imprisonment with a fine of Rs.1,000/- in default of which one month additional simple imprisonment vide order dated 02.05.2024 passed by Sessions Judge, Hardoi in Sessions Trial No.127 of 2013 (State v. Ajayveer Singh & Ors.) arising out of Case Crime No.168 of 2012, under Section 307/34, 504, 506 IPC, P.S. Pachdevra, District Hardoi.

6. Learned counsel for the applicant/appellant argues that the injury was not on a vital part, as such, prima-facie, Section 307 IPC was not made out. It is further argued that the appellant/applicant was on bail during trial and he did not misuse the said liberty. He is in jail since 02.05.2024 and has no criminal history of any major offence except for one offence which is minor in nature.

7. Considering the aforesaid fact, the appellant/applicant deserves to be enlarged on bail. In view thereof, the application for bail is allowed.

8. Let the appellant/applicant Kurindra Singh be enlarged on bail in aforesaid Sessions Trial/Case Crime Number, subject to

his furnishing a personal bond and two sureties of Rs.25,000/each to the satisfaction of the Court concerned.

9. Until further orders, realization of rest of the fine imposed by the Court below shall remain stayed subject to the applicant/appellant depositing Rs.2,500/- within a period of three months from the date of actual release.

10. The bonds after being accepted shall be transmitted to this Court for being kept on record of the file of appeal.
