Heard Sri Ravi Shanker Singh, learned counsel for the applicants and learned AGA for the State.
Present application under Section 482 Cr.P.C. has been filed to quash the entire proceeding of Criminal Case No. 10229 of 2023, arising out of FIR/Case Crime No. 249 of 2021, dated 20.03.2021, under Sections 420 IPC, Police Station-Kotwali Nagar, District-Pratapgarh.
Contention of the learned counsel for the applicants is that the applicant No.1 is a co-sharer of half of the land of Gata No. 2922 situated at Village-Altu Babuganj, District-Pratapgarh and on the basis of sale deed in question he has transferred his share by mentioning the boundaries of the transferred land which is similar to the boundaries shown in the sale deed by which applicant No. 1 had purchased his share from earlier tenure holder of the land.
It is further submitted that the dispute is essentially civil in nature but by the impugned proceeding it has been converted into criminal proceeding with oblique motive.
