Heard Sri Anil Kumar Dwivedi, learned counsel for the appellant through video conferencing, learned AGA for the State and perused the record.

The present criminal appeal under Section 14-A (1) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been filed challenging the charge-sheet dated 24.07.2020, summoning/cognizance order/NBW dated 04.11.2020 passed by learned Special Judge, SC/ST Act, Prayagraj in Session Trial No. 153 of 2020 (State of U.P. vs. Raj Dev Singh) arising out Case Crime No. 224 of 2020 under Sections 279, 429, 504 IPC and Section 3(2)(va) of SC/ST Act, Police Station Saray Inayat, District Prayagraj.

It has been submitted by learned counsel for the appellant that directly a non-bailable warrant has been issued without issuance of the summoning order and the bailable warrant. It has also been submitted that the appellant has been falsely implicated.

The appellant undertakes that he shall participate and cooperate in the trial proceedings. In case, the appellant cooperates in the trial proceedings, the NBW dated 04.11.2020 issued against the appellant shall remain in abeyance.

With the aforesaid observation, the criminal appeal is disposed of.
