It has been submitted that by means of impugned order dated 17.09.2024, application preferred by revisionists under Order 23 Rule 3 of the Code of Civil Procedure for withdrawal of suit with liberty to file a fresh has been rejected only on very technical grounds.
In view of submission so being made, it is directed that till next date of listing, proceedings of regular suit no.1566 of 2024; Sharad Kumar Mishra and Ors. versus Syed Sujat Husain & Ors. pending before the Court of Civil Judge (Senior Division) Mohan Lal Ganj, Lucknow shall remain stayed.
