Heard the counsel for the applicant.
The present contempt application has been filed pleading willful disobedience of the order dated 1.7.2009 passed by this Court in Civil Misc. Writ Petition No. 31866 of 2009.
It is contended by the applicant that in violation of the aforesaid order, the opposite party, who was the petitioner in the writ petition, has dispossessed the applicant from the disputed property and has changed the nature of the disputed property.
The facts which form the basis of the present contempt application are disputed questions of fact and cannot be decided on affidavit evidence. Further, the order of status-quo was, in effect, a direction to the revenue authorities to not change the possession.
The application is dismissed .
