The present contempt application has been filed pleading disobedience of the order dated 27.4.2024 passed by this Court in Writ-C No. 13873 of 2024.

The name of the brother of the applicant initially continued as the tenure holder of the property, but by order dated 22.6.2002 the name of the brother of the applicant was directed to be expunged from the revenue records and the name of the Gaon Sabha was directed to be recorded in the revenue records.

The dispute raised by the applicant is a dispute between himself and Rikhdeo and would require separate proceedings and could not have been considered in proceedings instituted under Section 33/39 of the U.P. Revenue Act, 1901.

Through order dated 1.8.2024 passed by the Additional District Magistrate, Finance & Revenue, District-Azamgarh, it was held that in view of the order dated 2.9.2022, it would not be feasible to consider the recall application filed by the applicant.

The opposite parties have taken note of the order dated 2.9.2002 passed in Civil Misc. Writ Petition No. 28487 of 2002 wherein the operation of the order dated 22.6.2002 has been stayed.

There is no illegality in the order passed by the opposite parties as the proceedings under Section 33/39 of the U.P. Revenue Act, 1901 were between Rikhdeo, i.e., the brother of the applicant and the Gaon Sabha and not between the applicant and the Gaon Sabha.

In view of the aforesaid, there is no disobedience of the order passed by the writ Court.

The contempt application is dismissed.
