It is evident from the record that being a dependent applicant, applicant moved an application before the competent authority for providing compassionate appointment considering Rule 9 of Dying in Harness Rules, 2011 as amended but the same was rejected vide order dated 5.2.2019, which was challenged in Writ A No.11367 of 2019 and the aforesaid writ was allowed on 23.1.2023 with the observation that case of the applicant is squarely covered under Rule 2(c)(iv) of the Dying in Harness Rules, 2011 as amended w.e.f. 22.12.2011 and respondent authority was also directed to consider the application of the applicant again and decide the same in accordance with the law.

Today, affidavit of compliance is filed by Mr. Rajesh Kumar Verma, Standing Counsel duly signed by Mr. Jitendra Kumar Tomar, Director, Agriculture, Krishi Bhawan, U.P., Lucknow and informs that case of the applicant was considered and was rejected vide order dated 10.4.2024.

It is evident from the affidavit of compliance filed today as well as order dated 10.4.2024 that observations made by the writ court have not been considered by the respondent, in such circumstances, the affidavit of compliance filed by respondent is hereby, rejected.

List this case on 23.9.2024 at 11:30 A.M.

By the next date of listing, complete record related to the compliance of direction of the writ court be placed before this Court.

In the meantime, respondent may file fresh
