Affidavit of compliance filed on behalf of respondent Nos.1 and 2 are taken on record.

Heard learned counsel for applicant and Shri Nishant Singh, Advocate holding brief for Shri Akhilesh Kumar, learned counsel for the respondents.

Learned counsel for the respondents has submitted that in compliance of judgement and order dated 22.11.2023, the candidature of the applicant has been considered for promotion to the post of Senior Clerk and the same has been kept in the seal over as departmental proceedings are pending against he applicant.

Learned counsel for the applicant has very fairly submitted that for all practical purposes, the judgement and order dated 22.11.2023 has been complied with, but in place of keeping the matter under seal cover, they should have declared the result of the applicant, otherwise for all practical purposes, the present contempt petition has become infructuous and the same may be dismissed as infructous but liberty may be given to the applicant to challenge the decision taken by the respondent by filing a writ petition.

As prayed, the present contempt application is dismissed as infructous with the aforesaid liberty.

Notice issued earlier, if any, stands discharged.
