Heard learned counsel for the applicant.

Present application has been filed with the prayer to summon and prosecute the opposite party for deliberate defiance of the order dated 15.05.2023 passed by the Writ Court in Habeas Corpus (WP) No.16 of 2023; Jaikrish Parmar through his father Vs. State of U.P. and Anr.

Learned counsel for the applicant submits that the marriage of applicant was solemnized with the opposite party, thereafter, due to some trivial disputes, FIR No.126/2022 under Sections 498A, 323, 504, 506, 406 IPC read with Section 3/4 of DP Act, P.S. Mahila Thana, Hazratganj, District- Lucknow was lodged by the opposite party on 20.09.2022 which was challenged before this Court in Criminal Misc. Writ Petition No.8151 of 2022, thereafter, the matter was sent to the Mediation Centre of this Court and on the basis of amicable written settlement between the parties, the aforesaid proceeding was quashed. Thereafter, Habeas Corpus (WP) No.16 of 2023 was preferred by the applicant, in which, vide order dated 15.05.2023, visitation rights of the child were given to the applicant but now the opposite party has changed her mobile number and she is not allowing the applicant to see the child, therefore, opposite party is violating the settlement as well as order dated 15.05.2023 passed in Habeas Corpus (WP) No.16 of 2023.

Let notice be issued to the opposite party within a week to show cause, as to why, he should not be punished for wilful disobedience of the directions of this Court, returnable within two weeks, failing which, the charges may be framed after summoning the contemnor.

Office is directed to send a copy of this order along with the notice.

List this case on 26.09.2024 at 11:30 AM.
