Heard learned counsel for the applicant.

The present application has been filed with the prayer to summon and punish the opposite party for willful and deliberate defiance of the order dated 19.02.2024 passed by the Writ Court in Writ A No.8821 of 2022.

Learned counsel for the applicant submits that initially the applicant was appointed as Medical Officer on 31.08.1986 on adhoc basis and he continued to work till 31.01.2012, as his services were not regularized, as a result, he was not entitled for pensionary benefit. He further submits that similarly situated persons have already been regularized and their adhoc service are also counted as qualifying service, therefore, benefit of pension is being given to them. Feeling aggrieved, Writ Petition No.33744 of 2018 was filed by the applicant which was disposed of on 01.10.2019 with the direction to the opposite party to decide the claim of the applicant but claim of applicant was rejected by the State Government on 06.10.2022, thereafter, the said order dated 06.10.2022 was challenged in Writ A No.8821 of 2022 which was allowed on 19.02.2022 with the direction to the State Government to regularize the service of the applicant in accordance with the Regulation Rules, 1979 but no action has been taken till date.

Let notice be issued to the opposite parties within a week to show cause, as to why, they should not be punished for wilful disobedience of the directions of this Court, returnable within two weeks, failing which, the charges may be framed after summoning the contemnors.
