Compliance affidavit filed by respondent i.e. Dr. Vijay Bahadur Dwivedi, Director Horticulture & Food Processing, Lucknow along with an application for discharge of the contempt notice as well as dismissal of the contempt application is taken on record.

Learned State Counsel has submitted that in compliance of the judgment and order dated 28.03.2024, the representation of the applicant has been decided by order dated 03.08.2024, the copy of which has been enclosed as Annexure No. 1 to the compliance report and now, nothing remains to be adjudicated and the contempt application may be dismissed and the notices may be discharged.

Learned counsel for the applicant has very fairly submitted that in compliance of the judgment and order dated 28.03.2024 passed by the Writ Court, the Director Horticulture & Food Processing has decided the representation of the petitioner and now nothing remains to be adjudicated in the present contempt application and the same may be dismissed as infructuous with liberty to the applicant to challenge the order dated 03.08.2024 by filing a writ petition.

As prayed, the present contempt application is dismissed as infructuous.

Notices are hereby discharged.

The applicant is always at liberty to avail the remedy as may be permissible under the law.
