Heard learned counsel for the applicant and learned Standing Counsel.

This application under Section 12 of the Contempt of Courts Act has been filed alleging wilful disobedience of the judgment and order dated 26.02.2024 passed on Writ-C No. 1879 of 2024.

Learned counsel for the applicant submits that Writ-C No. 1879 of 2024 filed by the applicant was disposed of by the writ Court vide order dated 26.02.2024 with the liberty to the applicant to prefer appeal under Section 31 of the Air (Prevention and Control of Pollution) Act, 1981. In pursuance of the order of the writ Court, the applicant filed the appeal on 06.03.2024. Submission of the learned counsel for the applicant is that as there was a direction of the writ Court to decide the appeal within a period of two months from the date of its institution, but till today, the same has not been decided, due to which, present contempt application was filed. It is also submitted that lastly, when the said appeal was listed on 12.08.2024, due to ill health of learned counsel appearing for the applicant, a request was made for adjournment for the first time on behalf of the applicant, however till today, the next date of listing of the appeal has not been informed to him. Learned counsel for the applicant vehemently submits that neither the facility of virtual hearing nor digital cause list is being uploaded by the appellate authority on the website/portal.

By the next date of listing, Shri Sunil Bajpayee, learned Additional Chief Standing Counsel shall seek written instructions from the Additional Chief Secretary, Department of Forest, Environment and Climate Changes, Government of U.P., Civil Secretariat, Lucknow that why the facility of virtual hearing and the digital cause list on the website/portal is not being provided to the litigants.
