The instant contempt application has been filed for punishing the respondents for willful disobedience of order dated 05.07.2023 passed in Writ-A No. 19083 of 2016.

On 07.05.2024 following order was passed:

"1. Heard.

2. Learned counsel for the applicant submits that the order dated 05.07.2023 passed by this Court in Writ-A No. 19083 of 2016 has been wilfully defied by the respondents.

3. List this case on 27.05.2024 as fresh.

4. In the meantime, Shri Prashant Kumar, learned Standing Counsel shall seek written instructions from the respondents about the fact that why the order of the Writ Court has not been complied with.

5. Learned counsel for the applicant is directed to provide a copy of the contempt application to learned Standing Counsel, forthwith."

Shri Prashant Kumar Singh, learned counsel appearing for the District Basic Education Officer informs that as per the telephonic instructions taken from respondent no.3 - Mr. Bhoolendra Pratap Singh, District Basic Education Officer, Ambedkar Nagar, the order of the Writ Court is being complied with and formal approval of Mr. Pratap Singh Baghel, Director of Basic Education, U.P. is needed in that regard.

It is well settled that once the order is passed by the Writ Court, then there is no question of getting approval from the higher authorities.
