3. In the meantime, Shri Sunil Bajpayee, learned Additional Chief Standing Counsel shall seek instructions from the respondent about the fact that why the order of the Writ Court has not been complied with.

2. In pursuance of earlier order dated 23.04.2024, Shri Mohit Jauhari, learned Additional Chief Standing Counsel, who appears for the respondent, requests for some time to file affidavit of compliance.

4. In case the order of the Writ Court is not complied with, then the respondent shall appear in person before this Court on the next date of listing. "

Shri Mithlesh Kumar, District Inspector of Schools, Shrawasti is present and has placed written instructions and informed that due amount of arrears of salary of applicant since 31.12.2018 to 31.12.2019 is Rs.6,45,732/-, as request has already been made to the Director, Secondary Education, Govt. of U.P., Lucknow for allocation of budget vide letters dated 03.05.2024, 22.05.2024 and 26.06.2024 but till today, no response has been given by him.

Learned counsel for the applicant is permitted to implead Dr. Mahendra Dev, Director, Secondary Education, Govt. of U.P., Lucknow as opposite party no.2, forthwith.

List this case on 05.07.2024.

On the next date, opposite party no.2 shall place written instruction explaining, as to why, the allocation of budge has not been made despite repeated request of District Inspector of Schools, Shrawasti, failing which, he shall appear in person before this Court.

Copy of contempt application for opposite party no.2 has been received by Shri Mohit Johri, learned Standing Counsel and he is directed to communicate this order to opposite party no.2 for necessary compliance, forthwith.
