The present contempt petition has been filed for the alleged non compliance of the order dated 21.11.2023 passed in Writ-A No.8999 of 2023.

Learned counsel for the applicant has submitted that the applicant was transferred in the most mechanical manner and the transfer order was challenged before this Court in which interim order was passed on 21.11.2023 but the same was not complied with and in the meantime, he was placed under suspension and thereafter suspension order was revoked but proper posting has not been given to him.

Sri Vinayak Saxena, learned Standing Counsel for the respondents has drawn attention of the Court to short counter affidavit filed by Sri Gauri Shanker Priyadarshi, Commissioner, Rural Development, U.P. Lucknow and submitted that vide order dated 11.03.2024 the applicant has been posted on the post of Assistant Commissioner in the office of Commissioner, Rural Development, Lucknow but he has not joined.

Learned counsel for the applicant has submitted that due salary as well as other arrears have not been paid to the applicant till today. He further submits that now the applicant is ready to join his duties.

Accordingly, the applicant is directed to appear in the office of Commissioner, Rural Development, U.P. Lucknow on 25.09.2024 at 11.30 a.m for submitting his joining.

It is expected that the competent authority shall allow the applicant to join his duties and rest of the due salary as well as other arrears be paid to him.

In terms of the aforesaid observation, the contempt application is hereby disposed of.
