Heard learned counsel for the applicant, learned AGA and perused the record.

The accused-applicant seeks bail in Case Crime No.397 of 2022 under sections 302, 120-B, 427 IPC, P.S. Badosarai, District Barabanki.

In terms of the FIR, the applicant was not named in the FIR. Subsequently, in the confessional statement, the name of the applicant surfaced.

It is argued that on the same allegations, one Lalit Kumar has been enlarged on bail by this court vide order dated 25.01.2024 in bail application No.14763 of 2023.

Considering the fact that the co-accused who was not named in the FIR and was implicated in similar manner as that of applicant, a case for bail, on the ground of party, is made out more so, when the applicant has no previous criminal history prior to the offence in question. Thus the bail application is allowed.

Let the applicant Sandeep Kumar Awasthi be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties of Rs.25000/- (Twenty Five Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶14

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
