1 . Heard learned counsel for the applicant, learned AGA and perused the record.

2. The present bail application has been filed by the applicant seeking bail in FIR No.20 of 1993, under Sections 2/3 of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986, Police Station Aliganj, district Lucknow.

3 . Learned counsel for the applicant argues that the applicant was earlier enlarged on bail. Subsequently, all the accused had died and also the Counsel for the applicant had died and the applicant could not attend the proceedings and was arrested and sent jail. He undertakes to co-operate with the trial.

4 . Learned AGA has opposed the bail application.

5 . Considering the submissions made at the Bar; the fact that the applicant is aged about 66 years and the undertaking that the applicant will co-operate with the trial, the applicant is entitled to be enlarged on bail. In view thereof, the application is allowed .

6 . Let the applicant Kasim on his furnishing a personal bond with two fresh sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶13

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶14

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
