Heard learned counsel for the parties on this application moved in court for permitting the applicant to withdraw amount from his LIC Fixed Deposit.

By moving the instant application, it is prayed that the applicant be permitted to withdraw his amount which is lying in his fixed deposit with the Life Insurance Corporation (hereinafter referred to as the 'LIC) and for withdrawal of the same, he will have to go to office of the LIC, Branch Barabanki. It is submitted that the applicant wants to settle the dispute with creditors, however, as he is detained in prison, he could not initiate the settlement and, thus, he be permitted to visit the LIC, Branch Barabanki.

During the course of deliberations, it is surfaced that still no application or any form required for the aforesaid purpose has been filled by the applicant.

Thus, Superintendent, District Jail, Barabanki is directed to facilitate the applicant if he is willing to fill any form for the purpose of withdrawal of his money lying in the Barabanki Branch of LIC and, if thereafter the presence of the applicant is required before the Barabanki Branch of the LIC, he would be taken in custody to the office of the Barabanki Branch of the LIC on the date so specified by an officer of LIC Barabanki Branch.

It is clarified that during his visit to Barabanki Branch of the LIC, the applicant shall remain in police custody and no compromise would be made with regard to his security.

Let a copy of this order be provided to the learned AGA for the purpose of onward communication to the Superintendent, District Jail, Barabanki free of cost and to learned counsel for the applicant on payment of usual charges.

With the aforesaid observations/directions, the instant permission application stands disposed of.
