It is contended by learned counsel for the applicant that the applicant is innocent and he has been falsely implicated in the present case due to ulterior motive. He submits that admittedly, the applicant was in custody of the family members and from the inquest report, it is evident that there was a mark of injury over the neck of the deceased and this fact has been ignored by the Investigating officer. He next submits that in fact, there is no proximity of abetment to commit suicide by the deceased and the Investigating Officer, without considering any cogent piece of evidence against the applicant, has submitted the charge sheet. He has also shown certain other falsity in the prosecution story and submitted that the charge sheet has been filed and there is no possibility of fleeing away by the present applicant from the investigation proceedings . There is no previous criminal history of the applicant, which has been explained in para 19 of the affidavit filed in support of the bail application. The applicant is a law abiding citizen, who is languishing in jail since 9.4.2024. In case, the applicant is granted bail, he will not misuse the liberty and will co-operate in the trial proceedings.
