Heard Shri Farrukh Khan, learned counsel for the applicant, Shri Anant Pratap Singh, learned A.G.A. for the State and perused the record.

The instant application has been filed seeking release of the applicant on bail in Case Crime No.119 of 2023, under Sections 120-B, 409, 420, 467, 468, 471 I.P.C. registered at Police StationHazratganj, District Lucknow.

The aforesaid case has been registered on the basis of F.I.R. lodged on 30.7.2023 against 18 persons, including the applicant, who was the Secretary of Dr. Bhim Rao Ambedkar Foundation which runs Jeevika Institutes of Pharmacy and regarding which it is alleged that the Institute claimed scholarship of five students by fraudulent means, without the students having actually taken admission in it.

The first charge-sheet was submitted against six persons. A Supplementary charge-sheet has been submitted against two persons, including the applicant and investigation against rest of the persons is still pending. From amongst eight persons chargesheeted, six have been granted bail and one person has been granted anticipatory bail.

Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that all the other charge-sheeted co-accused persons have been granted anticipatory bail/bail, I am of the view that the applicant is also entitled to be released on bail.

Accordingly, this bail application stands allowed .

Let the applicant- Ram Gopal be released on bail in the aforesaid case, on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to the following conditions: -

(i) the applicant shall not tamper with the prosecution evidence;

¶14

(ii) the applicant shall not pressurize the prosecution witnesses;

¶15

(iii) the applicant shall appear on each and every date fixed by the trial court.
