her and committed rape. One accused was carrying a pistol with him and has threatened the victim. In her statement recorded under Section 161 CrPC, she changed the story and has stated that on fateful day at 6:30 AM, she went to the jungle to ease out where both the accused persons were present. They clicked the naked photographs of the victim and threatened that they will circulate those photographs and on such threat they committed rape. In her statement recorded under Section 164 CrPC, she again changed the statement to the effect that both the accused persons compelled the victim to put off her clothes, thereafter they clicked the naked photographs of the victim and later on committed rape. However, while recording her evidence before the trial court and during cross-examination, she again change the story and has submitted that she had not gone to ease out in the jungle as there is toilet in her residence, but she had gone to jungle for the purpose of morning walk along with both the accused persons and both the accused persons committed rape with her after clicking the naked photographs. In her cross examination, she change the story and has stated that no naked photographs were clicked by the accused persons and she had not apprised this fact to the police or to the court. She has also stated that since no photos were clicked, therefore the photos were not circulated. In her statement, the expert witness, i.e., the Doctor has also stated that in her medical examination, there was no symptoms of physical assault on the body of the victim. The learned counsel for the applicant has stated that the victim has changed the allegations at every stage and there is no consistency in her statement. Even expert witness, i.e., Doctor has not verified the factum of rape. The present applicant is having no prior criminal history of any kind whatsoever. He is a young person and has been falsely implicated. Therefore, if he is enlarged on bail, he shall shall cooperate in the trial proceedings and shall not misuse the liberty of bail. Further, the applicant shall abide by all terms and conditions of the bail order, the applicant may be enlarged on bail.
