Heard learned counsel for the applicant, learned A.G.A for the State of U.P. and perused the record.

The present second bail application has been filed on behalf of the applicant in Case Crime No.271 of 2021, under Sections 406, 420, 467, 468, 471, 506 I.P.C., Police Station - Hazratganj, District - Lucknow, with the prayer to enlarge him on bail.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and he is in jail since 3.9.2021. He further submits that first bail application was rejected by this Court on 21.4.2023 with a direction to the trial court to conclude the trial expeditiously without granting unnecessary adjournment to either of the parties. He further submits that five witnesses have already been examined. He further submits that he will not involve in any illegal activities in the future. In these circumstances, the applicant is entitled for bail. In case of being enlarged on bail, he will not misuse the liberty of bail.

Learned A.G.A. as well as learned counsel for the complainant have opposed the prayer for grant of bail and submit that as per the applicant he was working as computer operator in the forest department on the contract basis but in his account there is a huge amount was reflected as he is alluring the youths for providing employment by taking money. They also submit that there are three cases against the applicant and F.I.R. for the offence of gangster act was also lodged, therefore, applicant is not entitled for bail.

Considering the rival submissions of learned counsel for applicant, learned A.G.A., material available on record, contents of F.I.R., other relevant documents, nature of offence as well as facts and circumstances of the case, I am of the view that the applicant is not entitled to be released on bail, accordingly, the bail application is hereby rejected .
