3. In terms of the FIR it was alleged that daughter of the informant aged about 17 years was raped by the applicant. It was stated that when she raised a hue and cry, the applicant was apprehended and he wanted the victim to change her religion. In the statement under Section 161 Cr.P.C., the victim stated that she was caught by the applicant, however, when she raised the hue and cry, her father came and both of them were taken home and were beaten by the father. She specifically stated that nothing wrong was done to her. Before the medical authorities also, she stated that nothing wrong was done to her. However, in the statement under Section 164 Cr.P.C., the victim stated that the applicant had committed wrong on her and when her father came back, the applicant ran away. The medical on record does not corroborate any allegations of rape. Before the trial Court, the victim corroborated the allegations, however in the cross-examination, the victim stated that when the wrong was being committed, she had caught both the hands of the applicant. She also stated that she did not know the applicant and during the commission of the offence, he had disclosed the name to the victim.
