Learned counsel for the applicant has stated that the present applicant has been falsely implicated and he has not committed any offence as alleged. Even if the prosecution story is taken on its face value, there is no enimity of the present applicant with the deceased. He has submitted that there is no motive or intention of the present applicant to kill the deceased. The prosecution story says that the victim sustained injuries when some persons were fighting and he tired to pacify such fight. The learned counsel has stated that the present applicant might have might have sustained injuries on account of any accident, inasmuch as the incident in question is said to have happened in the midnight. The victim/deceased received 8 injuries and those injuries are mostly lacerated injuries or contusions. No injuries have been caused with blunt object, whereas, the prosecution story says that the present applicant has caused injured upon the deceased by iron rod. The present applicant is not named in the First Information Report and he has no prior criminal history of any kind, whatsoever. The learned counsel has further submitted that if the applicant is released on bail, he shall shall cooperate in the trial proceedings and shall not misuse the liberty of bail. Further, the applicant shall abide by all terms and conditions of the bail order, the applicant may be enlarged on bail.
