Contention of learned counsel for the applicant is that the applicant is innocent and has falsely been implicated in the instant matter due to ulterior motive. He next submits that the general role has been assigned to all the accused persons for attacking over the injured persons with the weapons, namely, Axe and iron rod, whereas the specific role has been assigned by the injured persons to the present applicant for attacking with the iron rod, whereas the injury report of the two injured persons, namely, Indra Mohan Verma and Rama Devi is evident that those are caused by sharp edged weapon and, therefore, the role of the present applicant is distinguishable from the role of other accused persons, who have been assigned the role of having Axe. He next submits that the whole family members have been implicated due to anonymity and the applicant was not present on spot and the police has connected him falsely. He next submits that the applicant has no previous criminal history and he is languishing in jail since 24.11.2023 and he undertakes that in case, he is granted bail, he will not misuse the liberty of the same and would cooperate in the trial proceedings.
