Heard learned counsel for the applicant as well as learned AGA and perused the record.

The accused-applicant seeks bail in Case Crime No.0245 of 2022, under Sections 498-A, 323, 304-B IPC and 3/4 D.P. Act, P.S. Cantt., District - Ayodhya.

In terms of the FIR, it was alleged that the sister of the informant was married with the applicant and sufficient dowry was also given. Subsequently, on account of demand of dowry, the sister of the informant was hanged to death. The postmortem report on record indicates the cause of death as ante mortem hanging. Apart from the legature mark, no other injury was observed on the body of the deceased. The applicant is the husband and he is in jail since 16.07.2022.

Learned AGA vehemently opposed the bail prayer.

Considering the material on record, prima facie, there is no averment against the applicant that soon before the death, the applicant had harassed the victim either mentally or physically in relation to demand of dowry, the applicant is in custody since 16.07.2022 and has no criminal history, he is enlarged on bail. Thus the bail application is allowed .

Let the applicant Rajkumar be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties of Rs.20,000/- (Twenty Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶15

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶16

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
