Heard learned counsel for the applicant, Ms. Anjali Dubey, learned counsel for the respondent complainant as well as learned A.G.A. and perused the record.

In terms of the F.I.R., it was alleged that on account of irrigation of fields, a dispute occurred whereby all the accused caused injuries with the use of lathi, danda etc. The injury report on record indicates fracture on the femur and fracture on the right side and a lacerated wound on the eye brow. The victim was discharged after treatment. Hence, the applicant who is languishing in jail since 4.3.2023 having no criminal history of any major offence, may be enlarged on bail.

Learned A.G.A. opposed the prayer for bail.

Considering the nature of the injuries sustained by the informant coupled with the fact that no specific allegations were levelled against the applicant, the applicant who is languishing in jail since 4.3.2023 having no criminal history of any major offence, without expressing any opinion on merit, I am of the view that the applicant is entitled to be released on bail.

Accordingly, the bail application is allowed.

Let the applicant Ashok Mishra be released on bail in FIR/ Case Crime No.64 of 2023, under Sections 307, 323, 324, 504, 506 I.P.C, Police Station Jamo, District Amethi on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court

concerned with the following conditions :-

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶14

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶15

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
