Heard learned counsel for the applicant, Sri Santosh Kumar Pandey who appears for the informant as well as learned AGA and perused the record.

The accused-applicant seeks bail in Case Crime No.0362 of 2023 under section 302, 427 and 34 IPC, P.S. Kotwali Bikapur, District Ayodhya.

It is argued that three of the co-accused have been enlarged on bail. As regards the applicant, it is argued that the name of the applicant was taken along with the other co-accused of causing injury and nothing specific was alleged against the applicant, however danda was recovered allegedly at the pointing out of the applicant.

Considering the allegations against all the co-accused who have been enlarged on bail of hitting the deceased being similar coupled with the fact that the criminal antecedents have been explained in para 32, as such, the ground of parity, the applicant is also entitled for the bail. Thus the bail application is allowed.

Let the applicant Virendra Kumar Pandey be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶13

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
