The contention of learned counsel for the applicant is that the applicant is innocent and has falsely been implicated in the instant matter due to ulterior motive. He submits that in fact as per the prosecution story, the applicant has no direct role contrary, it has been alleged that he helped the Branch Manager while getting arranged one person and except apart there is no specific role. He next submits that no amount has ever been credited in the account of the applicant as is alleged to have misappropriated by committing cheat & fraud. He submitted that the Investigation Officer without collecting cogent piece of evidence against the applicant, has filed the chargesheet and there is no complaint that the applicant has ever absconded from the investigation proceedings. He next added that identically situated co-accused, namely, Shailesh Kumar Raghuvanshi has already been enlarged on bail in Criminal Misc. Bail Application No. 8889 of 2024 vide order dated 13.12.2024 passed by this Court and applicant is seeking parity of the same. He further submitted that the applicant has no previous criminal history as is mentioned in para no. 15 of the bail application and he is languishing in jail since 17.06.2024 and he undertakes that in case, he is granted bail, he will not misuse the liberty of the same and would cooperate in the trial proceedings.
