Heard learned counsel for the applicant, learned AGA and perused the record.

The accused-applicant seeks bail in FIR/Case Crime No.0233 of 2024 under section 70(1) BNS, Police Station Jankipuram, District Lucknow.

The FIR in question was lodged alleging that the applicant had called the victim and when she went on there, she saw four persons on a scooty and a bike and she was taken behind a school and taken to a secluded place where wrong was also committed by the said persons.

In the statement under section 180 Cr.P.C., the victim stated that the friends of the husband one Uzaif called her and she had gone on a scooty. She admitted that she was with the applicant for the entire night. The similar statement was given under section 183 Cr.P.C., the tentative age of the victim is more than 19 years.

Considering the two statements coupled with the fact that the medical does not corroborate the allegations of rape, prima-facie a case for bail is made out more so when the applicant has no criminal history and is in custody since 29.07.2024. Thus the bail application is allowed.

Let the applicant Mobin Adees be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties of Rs.20,000/- (Twenty Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶13

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶14

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
