2 . It is argued by the counsel for the applicant that co-accused were enlarged on bail vide separate orders. The criminal history of the applicant are two cases, the applicant claims that he has no knowledge of one of the case and in the other case under the Arms Act, he has been enlarged on bail.
3. Learned A.G.A. as well as the counsel for the informant opposed the bail prayer.
4. Considering the fact that co-accused with similar allegation have been enlarged on bail and the criminal history has been duly explained on the ground of parity, the applicant is enlarged on bail. Accordingly, the bail application is allowed .
5. Let the applicant Gullu @ Vijay Bahadur Rajbhar be released on bail in FIR/ Case Crime No. 202 of 2023, under Sections 302, 120-B IPC, Police Station Akhand Nagar, District Sultanpur, on his furnishing personal bonds and two reliable sureties each in the like amount to the
satisfaction of the court concerned with the following conditions:
(a) The applicant shall execute a bond to undertake to attend the hearings;
(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and
(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer or tamper with the evidence.
