Heard, Shri Shailendra Singh, learned counsel for the applicant and Shri Lalit Shukla, leaned counsel for the opposite party.

This is an application under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of Arbitrator.

This Court had passed the following order on 25.04.2024:-

"Heard, Ms.Divya Niranjan, learned counsel for the applicant and Shri Lalit Shukla, learned counsel for the respondent.

This is an application under Section 11 (4) of the Arbitration and Conciliation Act, 1996 for appointment of Arbitrator for resolution of dispute arising out of contract with respondent no.1 in terms of Clause 13 of the agreement entered into between the parties on 29th of August 2019. There is consensus amongst learned counsel for the parties that there is a dispute, which requires to be resolved through an Arbitrator in terms of the agreement and despite notice no Arbitrator has been appointed. In view of above, this Court proposes to appoint Hon'ble Mr.Justice Alok Kumar Singh, Resident of House No.B-1/289, Vikrant Khand, Gomti Nagar, Lucknow as Arbitrator to settle the dispute between the parties. Let a copy of the pleadings on record alongwith the relevant provisions of the amending Act 2015 be sent to Hon'ble Mr.Justice Alok Kumar Singh, Resident of House No.B-1/289, Vikrant Khand, Gomti Nagar, Lucknow, for eliciting his disclosure in terms of Section 11(8) read with Section 12(1) of the Act, 1996 and Schedule VI and VII as amended by Act 2015, appended thereto, as also his consent for appointment as an Arbitrator for resolving the dispute.

Learned counsel for the applicant shall supply an additional copy of the application to the office for the said purpose within a week. List after receipt of reply/consent."

The proposed Arbitrator has sent his consent through letters dated 25.07.2024 and 30.07.2024 in accordance with law.

In view of above Hon'ble Mr.Justice Alok Kumar Singh, Resident of House No.B-1/289, Vikrant Khand, Gomti Nagar, Lucknow, a Retd. Judge of this Court is hereby appointed as an Arbitrator to decide the dispute between the parties herein.

The application is, accordingly, disposed of .

Let a copy of this order be communicated forthwith to Hon'ble Mr.Justice Alok Kumar Singh, Resident of House No.B-1/289, Vikrant Khand, Gomti Nagar, Lucknow.
