Sri Amit Kumar Singh, learned counsel for the applicant submits that the parties had entered into an agreement on 25.04.2018 for supply of food supplements by the applicant to the respondent. However, some dispute arose in regard to the payment therefore the applicant moved representations for settlement through mutual discussion but since there was no response, therefore the applicant gave notice for appointment of arbitrator on 02.07.2024 in terms of Clause 1.13 of the agreement. However, no reply to the same has been given therefore the applicant is constrained to approach this Court for appointment of arbitrator.
Sri Hari Govind Upadhyay, learned Additional Chief Standing Counsel prays for and is granted two weeks time to seek instruction and file objection, if any.
