The present Anticipatory Bail Application has been filed with the prayer to grant anticipatory bail to the applicant - Punni @ Peter @ Shivam , in Case Crime No. 290 of 2022, under sections 323, 384, 307 I.P.C., Police Station South, District Firozabad.

Heard learned counsel for the applicant as well as learned AGA and perused the material available on record.

It is submitted by learned counsel for the applicant that the applicant is suffering from liver cancer and as such he is not in a position to appear before the court concerned. At this stage, learned counsel for the applicant has drawn the attention of this Court to the charge sheet which is at page 75 of the paper book where the police recorded that the applicant is suffering from liver cancer and he is not well. Learned counsel for the applicant submits that he may be permitted to execute bond with sureties before the court concerned in terms of section 88 Cr.P.C.

In view of the prayer made by learned counsel for the applicant coupled with the fact that the applicant is suffering from liver cancer applicant is permitted to file an application under section 88 Cr.P.C. before the court concerned for execution of the bond with sureties to the satisfaction of the court concerned. In the event, such an application is filed, the court concerned shall permit the applicant to execute the bond if the applicant is able to show to the court concerned that the applicant is suffering from liver cancer. The application be filed within 15 days from today before the court concerned.

Till decision of the application filed by the applicant under section 88 Cr.P.C., the applicant shall not be arrested in the aforesaid case.

With the directions made above, the anticipatory bail application is disposed of.
