The present Anticipatory Bail Application has been filed with the prayer to grant anticipatory bail to the applicant - Shahwaz Ahmad, in Case Crime No. 374 of 2023, under sections 420, 406, 504, 506, 467, 468, 120-B I.P.C., Police Station Khandauli, District Agra.

Heard learned counsel for the applicant, Sri Yash Garg, learned counsel for the informant and learned AGA for the State.

Learned counsel for both the parties submit that in the present case there is a commercial dispute between the parties and the matter may be referred to the Mediation and Conciliation Centre, Allahabad High Court for taking an effort for settlement between the parties.

This matter/dispute is hereby referred to Mediation and Conciliation Centre, Allahabad High Court. Mediation Centre is expected to conclude its proceedings within two months. Parties to appear before the Mediation Centre on 24.07.2024.

List thereafter along with report of Mediation Centre before appropriate Bench.

As an interim protection, till the next date fixed for final hearing on this application, the applicant is granted interim anticipatory bail in the aforesaid case crime number. In the event of arrest of the applicant, he shall be released on interim anticipatory bail on his furnishing a personal bond of Rs. 25,000/- with two sureties each in the like amount to the satisfaction of the Station House Officer of the police station concerned with the following conditions:-

(i) The applicant shall make himself available for interrogation by a police office as and when required.

(ii) The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police office.

(iii) The applicant shall not leave India without the previous permission of the Court concerned.

(iv) In the event, the applicant changes residential address, the applicant shall inform the court concerned/Investigating Officer about new residential address in writing.

In case of default of any of the conditions, the Investigating Officer shall be at liberty to file appropriate application for cancellation of interim protection granted to the applicant.
