Heard learned counsel for the applicant as well as learned AGA and perused the material available on record.

The present Anticipatory Bail Application has been filed with the prayer to grant anticipatory bail to the applicant - Sumit Agarwal in Case Crime No. 05 of 2024, under Sections 420 and 409 I.P.C., Police Station - Civil Line, District - Muzzafarnagar.

It is submitted by learned counsel for the applicant that applicant is employee of the Bank and the allegation against applicant is that applicant has embezzled Rs.55,00,000/- out of which applicant has already paid Rs.11,00,000/-. Learned counsel for the applicant submits that remaining amount would be deposited by the applicant in two monthly installments.

Learned A.G.A. opposed the prayer.

As requested, learned AGA is allowed three weeks' time to file counter affidavit.

List this case on 12.9.2024.

In view of statement made by learned counsel for the applicant, applicant may deposit Rs.25,00,000/- on or before 9.9.2024 and remaining amount on or before 9.10.2024.

As an interim protection, till the next date fixed for final hearing on this application, the applicant is granted interim anticipatory bail in the aforesaid case crime number. In the event of arrest of the applicant, he shall be released on interim anticipatory bail on his furnishing a personal bond of Rs.25,000/- with two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:-

(i) The applicant shall make himself available for interrogation by a police office as and when required.

(ii) The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police office.

(iii) The applicant shall not leave India without the previous permission of the Court concerned.

¶16

(iv) In the event, the applicant changes residential address, the applicant shall inform the court concerned/Investigating Officer about new residential address in writing.

¶17

In case of default of any of the conditions, the Investigating Officer shall be at liberty to file appropriate application for cancellation of interim protection granted to the applicant.
