Heard learned counsel for applicant, learned counsel for the complainant and learned Additional Government Advocate for State as well as perused the record.

The present application for anticipatory bail has been filed for protection in regard to Case Crime No.595 of 2022, under Section 409 Indian Penal Code, Police Station Gosaiganj, District Sultanpur.

It is evident from the record that allegation on the applicant who was posted as Gram Panchayat Adhikari, Banmayi had misused his official position and has shown presence of one labour on the same date at 2-3 places regarding the maintenance work done in various institutes of Gram Panchayat such as ANM Centre, Primary School, Divyang Sauchalaya, Panchayat Bhawan etc. thus, has drawn the wages of labours for 2-3 works done by the same labour on same date and time and has usurped the public money.

In view of above, prima facie the complicity of the applicant is evident, allegations are serious in nature and the F.I.R. has been lodged by a Gram Panchayat Member therefore, it cannot be said that it is a case of false implication, there is allegations of embezzlement of public money, I am not inclined to grant anticipatory bail to the applicant. The bail application is rejected .
