It is submitted by learned counsel for the applicant that he is innocent and has been falsely implicated in this case. He was wedded to opposite party no. 2 but on account of mutual dispute, present case was got registered by the opposite party no. 2 against the applicant under Sections 376, 342, 420, 506 IPC in which after investigation final report was filed but later on in pursuance to the order passed by the Superintendent of Police for re-investigation of the case, charge sheet was filed under Sections 376, 377, 354, 342, 420, 504, 506 IPC. The statement of victim was recorded under Section 164 Cr.P.C. before the learned court and she filed an application under Section 125 Cr.P.C. as Crime No. 05 of 2022 before the learned Family Court for maintenance in which she clearly admitted that she was wedded wife of the applicant. The applicant also filed a petition under Section 13 Hindu Marriage Act and before the learned Family Court which is still pending. During the course of investigation, he released on anticipatory bail but after submission of charge sheet, he is under apprehension of imminent arrest. In case, he is released on bail, he would not misuse the liberty of bail and would cooperate with the trial.
