Heard learned counsel for the applicants, learned A.G.A for the State and also perused the record.
The present application under Section 483 Cr.P.C. has been filed seeking direction to the court below to conclude and decide the pending Case No. 981 of 2013, Case Crime No. 252 of 2013, u/s 401 I.P.C., Case Crime No. 253/2013 u/s 3/25 Arms Act, Case Crime No. 254/2013 u/s 4/25 Arms Act (State Vs. Satya Bhan alias Dagdha and others), P.S.-Suriyanwan, District-Bhadohi, pending in the court of Judicial Magistrate Ist, Bhadohi, Gyanpur within stipulated period.
In compliance of order dated 05.07.2024, a report dated 31.08.2024 has been received from Civil Judge (Senior Division)II, Bhadohi at Gyanpur. The report indicates that the charges have already been framed against the appellants on 17.02.2014 and the matter has been fixed for prosecution evidence. As the appellant nos. 1 and 2 are absent and not appearing before the court concerned, the non-bailable warrants have already been issued against them. The reasons for the delay are obvious.
Therefore, there is no merit in the present application and the same is, accordingly, dismissed.
