Heard Mr. Dharmendra Kumar Mishra, the learned counsel for applicant, the learned A.G.A. for State and Mr. V.K. Pandey, the learned counsel for first informant.

Charge sheeted accused Vinit Kumar Dubey, has approached this Court by means of present application with the following prayer:

"It is therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the application and to quash the entire proceeding of the Criminal Case No. 35 of 2023 State versus Abhishek and others under section 406, 419, 420, 467, 468, 471, 506 I.P.C. Police Station Khutahan, District Jaunpur (arising out of Case Crime No. 219 of 2021) pending before Additional Civil Judge (J.D.) VII/Judicial Magistrate, Jaunpur against the applicant as well as quash the Summoning order dated 21.06.2023.

It further prayed that to stay the further proceeding of the Criminal Case No. 35 of 2023 State versus Abhishek and others under section 406, 419, 420, 467, 468, 471, 506 I.P.C. Police Station Khutahan, District Jaunpur (arising out of Case Crime No. 219 of 2021) pending before Additional Civil Judge (J.D.) VII/Judicial Magistrate, Jaunpur during pendency of the this Hon'ble court so that justice be done, otherwise Applicant shall suffer irreparable loss an injury.
