1. Heard Sri Prabhat Kumar Mishra, learned counsel for the applicant, learned A.G.A. for the State and perused the material available on record.

2. The instant application under Section 482 Cr.P.C. has been filed by the applicant for quashing the entire criminal proceedings of Criminal Misc. Complaint Case No.72340 of 2015 bearing Computerised Case Number/ CNR UPLK040882142021 titled as Ranjeet Kumar vs. Ajmeri, under Section 138 N.I. Act, 1881, Police Station Itaunja, District Lucknow, pending in the court of Additional court No.5, District Lucknow, as well as for staying the impugned summoning order dated 25.10.2021 passed in the aforesaid complaint case.

3. Learned counsel for the applicant has submitted that the dispute between the applicant and opposite party No.2 is civil in nature. Therefore, he has stated that there is a possibility of resolution of their dispute through the process of mediation.

4. Having regard to the nature of dispute between the parties, there appears a fair possibility of

resolution of their dispute through the process of mediation.

5. Issue notice to the opposite party No.2, returnable at an early date.

6. Steps be taken within a week.

7. List this matter on 06.11.2024 . On which date, the applicant and opposite party No.2 shall appear in person before this Court so that the possibility of amicable settlement of their dispute through the process of mediation may be explored.

8. The applicant, in order to show his bona fide , shall deposit an amount of Rs.15,000/- within a period of two weeks from today before the Senior Registrar of this Court.

9. Till the next date of listing, impugned summoning order dated 25.10.2021 or any process issued, pursuant thereto, shall not be given effect to qua the applicant.

10. It is made clear that in case of default in depositing the amount by the applicant as directed above or on non-appearance of the applicant before this Court on the next date of listing, the interim protection granted herein above shall automatically come to an end without any further reference of this Court.
