Learned counsel for the petitioner has stated that opposite party no.2 has falsely implicated the petitioner in the present case, having ulterior motive and extraneous design in mind. Attention has been drawn towards the FIR dated 27.07.2022, being case Crime No.0288 of 2022 lodged under Sections 376 and 506 IPC, wherein the prosecutrix has herself stated her age to be 44 years. Learned counsel for the petitioner has stated that the prosecutrix is a married lady and has implicated one more person except the petitioner and the allegations against the petitioner are mis-conceived.. Further attention has been drawn towards annexure no.-11 which is order dated 05.08.2022, staying the arrest of the petitioner till filing of the chargesheet, further attention has been drawn towards annexure No.-12 which is an order dated 05.09.2023 in Anticipatory bail Application under Section 438 CrPC No.1972 of 2023, which has been allowed.
