Heard learned counsel for the applicant and learned A.G.A. for the State.
This Court on 16.10.2024, passed the following order :-
"Case called out.
Sri Anil Kumar Tiwari, learned counsel for the applicant and learned A.G.A. for the State are present.
As per office report dated 15.10.2024, service report in respect of opposite party nos.2 and 3 is awaited.
Pursuant to order dated 19.09.2024, passed by a coordinate Bench of this Court, the amount of Rs.1,00,000/- has already been deposited by the applicant and the receipt of the same is available on record.
In view of the above, list this matter again on 19.11.2024. On which date, the applicant and opposite party nos.2 and 3 shall appear in person in terms of the order dated 19.09.2024.
Interim order, if any, shall continue to operate till the next date of listing."
Office report dated 18.11.2024 reveals that the service report is still awaited as the notice could not be served because of the fact that the date of hearing mention in the notice has already lapsed.
Office is directed to issue fresh notice to opposite party nos.2 and 3, returnable at an early date.
Steps be taken within a week.
List this matter again on 21.01.2025. On which date, the applicant and opposite party nos.2 and 3 shall appear in person in terms of the order dated 16.10.2024.
Interim order, if any, shall continue to operate till the next date of listing.
