Sri Suresh Kumar Yadav, Advocate, has put in appearance for the private opposite party nos. 2 and 3 and has filed his Vakalatnama, which is taken on record.
Heard.
The present application has been filed for the following main reliefs:-
"Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the entire proceedings of Case No 2825 of 2017, State Vs Deepak Mishra and others, arising out in Case Crime No - 181 of 2017, Under Section - 323, 504, 308 I.P.C., Police Station Kotwali Akbarpur, District Ambedkar Nagar, pending in the court of Learned Chief Judicial Magistrate Ambedkar Nagar, in the light of compromise deed dated 14-08-2024 took place between the parties, in the interest of law and justice."
Learned counsel for the applicant submits that as certain error has crept, while filing the present application, as such the applicant may be permitted to withdraw the present application with liberty to file a fresh.
To the aforesaid prayer, learned A.G.A. has no objection.
Accordingly, the present application is dismissed with liberty as aforesaid.
